Welcome to SkillsHR Academy. These Terms and Conditions govern your access to and use of the SkillsHR Academy website, learning platform, courses, live sessions, assessments and related educational services.
SkillsHR Academy is operated by skillsHR GmbH, Bahnhofgürtel 59, 8020 Graz, Austria, registered under company number FN 511049 v.
By registering an account, purchasing a course or using the Academy, you confirm that you have read and accepted these Terms and Conditions.
1. Scope of Application
These Terms apply to learners, students, instructors, administrators and other authorized users of SkillsHR Academy.
Additional conditions displayed on a course description, quotation, order form or checkout page form part of the agreement for that specific service. If there is a conflict, the specific conditions shown for the purchased service take priority.
2. User Eligibility and Registration
- You must provide complete, current and accurate information when creating your account.
- You must be at least 18 years old or have permission from a parent, legal guardian, employer or responsible organization.
- Your account is personal and may not be shared, transferred, rented or sold.
- You are responsible for keeping your password and authentication details confidential.
- You must notify us promptly if you suspect unauthorized access to your account.
3. Courses and Learning Services
SkillsHR Academy provides online educational content that may include recorded lessons, live sessions, documents, exercises, assignments, quizzes, communications and other learning materials.
Course descriptions, schedules, instructors, learning objectives and access periods are displayed on the relevant course page or communicated separately. We may make reasonable educational or organizational changes when necessary, provided that the essential nature and value of the purchased service are not materially reduced.
4. Live Sessions
Live-session dates and times may be displayed in the Academy or communicated electronically. You are responsible for checking the applicable time zone and joining on time.
A live session may be rescheduled or replaced when an instructor is unavailable or when technical or organizational circumstances require it. Where reasonably possible, affected users will be notified in advance.
Live sessions may be recorded only when participants have been appropriately informed and when the recording complies with applicable privacy requirements.
5. Prices, Payments and Taxes
The applicable price, currency, taxes and payment conditions are shown before completing a purchase or are specified in the applicable quotation or organizational agreement.
Access to paid content may begin only after successful payment or confirmation by the responsible organization. Failed, reversed or disputed payments may result in temporary suspension of the related access.
Organizations purchasing access for their employees or learners remain responsible for payments made under their organizational agreement.
6. Consumer Right of Withdrawal
If you are a consumer in the European Union or European Economic Area, you may have a statutory right to withdraw from a distance contract within 14 days, subject to the applicable legal requirements and exceptions.
For digital content that is not supplied on a physical medium, the right of withdrawal may expire after delivery begins if you have expressly requested immediate access and acknowledged that you may lose your withdrawal right.
If you request that a service begin during the withdrawal period, you may be required to pay a proportionate amount for services already provided where permitted by law.
Any specific withdrawal instructions provided during checkout or in your order confirmation form part of these Terms. Mandatory consumer rights are not limited by this section.
7. Cancellations and Refunds
Cancellation and refund conditions displayed during checkout, stated in a quotation or agreed with an organization apply to the relevant purchase.
Unless mandatory law or an expressly stated refund policy provides otherwise, fees are not refundable after digital course access has started or substantial educational services have already been provided.
If SkillsHR Academy cancels a paid service without providing a reasonable replacement, affected users will receive an appropriate remedy, such as a replacement date, account credit or refund for the undelivered portion.
8. Acceptable Use
You agree not to:
- Share your account or allow unauthorized persons to access it.
- Copy, record, download or distribute course content except where expressly permitted.
- Upload unlawful, harmful, discriminatory, misleading or infringing content.
- Harass instructors, learners, staff members or other Academy users.
- Attempt to bypass security controls or gain unauthorized access to accounts, systems or data.
- Use automated tools to scrape, reproduce or overload the Academy.
- Manipulate assessments, attendance, certificates or learning records.
- Use the Academy in violation of applicable Austrian or European Union law.
9. Assessments and Academic Integrity
Users must complete assignments, tests and other assessed activities honestly. Unless collaboration or external assistance is expressly permitted, submitted work must be the user's own.
Cheating, impersonation, unauthorized use of answer materials or manipulation of assessment results may result in invalidation of results, removal from a course or suspension of the account.
10. Certificates and Learning Records
A certificate issued by SkillsHR Academy confirms participation, completion or achievement according to the requirements stated for the relevant course.
A certificate does not constitute a government-recognized, university or professional qualification unless this is expressly stated in the course description.
Certificates and learning records may be corrected or withdrawn if they were issued based on incorrect information, technical error, fraud or a violation of academic-integrity requirements.
11. Intellectual Property
Course materials, videos, recordings, text, graphics, trademarks, software and other Academy content are owned by skillsHR GmbH, its instructors or its licensors and are protected by intellectual-property laws.
Users receive a limited, personal, non-exclusive and non-transferable right to use the provided materials for the intended learning purpose during the applicable access period.
No ownership rights are transferred to the user. Commercial reproduction, publication, resale, public distribution or creation of derivative products requires prior written permission.
12. User-Submitted Content
You retain ownership of content you submit to the Academy. You grant SkillsHR Academy the limited rights necessary to store, process, display and evaluate that content for providing the learning service.
You confirm that submitted content does not violate the rights of another person and that you are authorized to provide it.
13. Technical Requirements and Availability
You are responsible for having a compatible device, supported browser, stable internet connection and any equipment required for the selected course.
We aim to keep the Academy available and secure, but uninterrupted or error-free operation cannot be guaranteed. Temporary interruptions may occur because of maintenance, updates, hosting failures, security incidents or events outside our reasonable control.
14. External Services and Links
The Academy may contain links to external websites or integrate third-party services. Those services may be governed by their own terms and privacy policies.
SkillsHR Academy is not responsible for external content or services that it does not operate, except where liability is required by applicable law.
15. Privacy and Communications
Personal data is processed according to the SkillsHR Academy Privacy Policy and applicable data-protection law.
Service-related messages, including security notices, account verification, course administration and essential learning communications, may be sent when necessary to operate your account or provide a contracted service.
Optional marketing communications are sent only when there is a valid legal basis and may be unsubscribed from at any time.
16. Account Suspension and Termination
You may stop using your account at any time. Requests concerning account closure or personal data may be sent to office@skillshr.at.
We may restrict or suspend an account when reasonably necessary to protect the Academy, investigate suspected misuse, prevent security risks, comply with a legal obligation or respond to a material violation of these Terms.
Where appropriate, the user will be informed of the reason and given an opportunity to resolve the issue. Serious fraud, unlawful activity or immediate security threats may result in suspension without prior notice.
17. Liability
SkillsHR Academy provides educational services and does not guarantee a particular employment, examination, business or professional outcome.
To the extent permitted by law, SkillsHR Academy is not liable for indirect or consequential losses resulting from the use of the Academy.
Nothing in these Terms excludes or limits liability where exclusion is prohibited by law, including mandatory liability for intentional misconduct, gross negligence, personal injury or mandatory consumer rights.
18. Force Majeure
SkillsHR Academy is not responsible for delays or failure to perform caused by circumstances outside its reasonable control, including major network outages, natural disasters, public-authority actions, labor disruptions, epidemics or failures of essential third-party infrastructure.
19. Changes to These Terms
These Terms may be updated to reflect legal, technical or operational changes. The current version and its update date will be published on the Academy.
Material changes affecting an ongoing paid service will be communicated where required. Changes will not retroactively remove mandatory rights already acquired by users.
20. Governing Law
These Terms are governed by Austrian law, subject to mandatory consumer protections that apply in the user's country of residence.
Statutory rules concerning jurisdiction and consumer dispute rights remain unaffected.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be replaced or interpreted as closely as legally possible to its intended purpose.
